At the time of publication of this symposium issue, the Court of Appeals was rehearing Lotus Development Corporation v. Borland International, Inc. as a result of the recusal of Judge Stephen G. Breyer, who was appointed to the United States Supreme Court. University of Pittsburgh School of Law Professor Pamela Samuelson made a presentation based on this brief at the HASTINGS COMMUNICATIONS AND ENTERTAINMENT LAW JOURNAL'S Sixth Annual Computer Law Symposium held February 12, 1994 at the University of California, Hastings College of the Law.
