Description

This panel will look at potential avenues for expanding employment discrimination law in the future. Panelists will look back at employment law under the Reagan administration and the development of the private right of action under Title VII to provide insight into how this history can provide lessons for preserving employment law during and after the Trump administration. Panel topics will also include how the populist rhetoric and promises of Trump’s campaign could be harnessed to encourage administrative venues to further construct and maintain an antidiscrimination framework. In addition, panelists will discuss rethinking the Fifth Amendment’s scope and meaning to develop new legal and political paradigms for racial equality going forward.
